Terms of Service

1. Agreement

These Terms govern your use of Small Biz Marketing Kit (the "Service"), operated by YNdigitalmarketing ("we," "us"). By creating an account or using the Service, you agree to these Terms.

2. The Service

Small Biz Marketing Kit is an AI-powered marketing assistant that helps you generate marketing content, audits, ideas, emails, and campaign plans. Features may change over time.

3. Accounts

You must provide accurate information, keep your login secure, and are responsible for activity under your account. You must be at least 18 and able to form a binding contract.

4. Subscriptions and billing

• The Service offers a free trial and paid plans (Starter and Professional), billed monthly through our payment processor, Stripe.
• Subscriptions renew automatically each month until cancelled. You can cancel anytime in your billing settings; cancellation takes effect at the end of the current billing period.
• Fees are non-refundable except where required by law.
• We may change prices with reasonable notice.

5. Acceptable use

You agree not to misuse the Service, including: violating laws; infringing others' rights; sending spam or unlawful content; attempting to disrupt or reverse-engineer the Service; or using it to generate harmful, deceptive, or illegal content.

6. AI-generated content

The Service uses AI to generate content. AI output may be inaccurate, incomplete, or unsuitable, and is provided for your review. You are responsible for reviewing, editing, and deciding whether to use any generated content — including ensuring it is accurate and compliant before you publish or send it. We do not guarantee results.

7. Your content and ownership

You retain rights to the content you input and, as between you and us, to the outputs generated for you. You are responsible for your content and how you use it. We own the Service itself, including its software and branding.

8. Third-party services

The Service relies on third parties (such as Stripe, OpenAI, Supabase, and Google). Your use of those features may also be subject to their terms.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that AI output will be accurate.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms.

12. Governing law

These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada.

13. Changes

We may update these Terms; continued use after changes means you accept them.
